This Privacy Policy sets out and describes what kind of information is collected and stored, how that information is used, when it may be disclosed, what safety measures are taken to ensure privacy and confidentiality, how you may opt out of marketing communications and how to lodge a formal complaint.

PERSONAL INFORMATION

            

If you engage with me via this website or choose to engage my services as a client, I may collect some personal information from you which could include the following:

  • Contact details – name, email address, phone number, address, date of birth

  • Interests and preferences – topics that you are interested in and/or services and products that you would like to know more about

  • Analytics – data gathered by Google Analytics that is used to analyze traffic and improve the usability of this website. You can opt out of this function by downloading a browser add-on such as https://tools.google.com/dlpage/gaoptout

  • Other details – any other information you choose to disclose via communication with me in the form of emails, comments across any platforms as well as contact and intake forms

 

COLLECTION AND USE

 

The following are ways in which I may collect information from you:

  • Contact form – located on this website, so I can answer any queries you may have

  • Direct email

  • Phone call

  • Booking and intake forms – when you choose to engage in a nutritional medicine consultation with me 

  • Social media – interaction that may occur via direct message or through comments on the business pages

  • Mailing list sign up – when you sign up to the mailing list to receive things such as blog posts, exciting new research and information, recipes, health and wellness tips, as well as any new promotions

  • Google Analytics – collects data about how you interact with my webpage

 

I will only use this information in conducting my business in order to offer you the highest level of service possible, to provide you with relevant and useful information if you choose to subscribe to the mailing list, and to continuously work on improving the services I provide as well as the usability of this website and other marketing strategies such as social media.

 

I will only collect personal information from you with your full awareness and consent, such as when you fill in the required boxes to book a consult or receive an answer to your query, and as clearly depicted in this Privacy Policy. You may be required to provide additional information for administrative purposes in order for me to carry out the service(s) you request, however this will be clearly communicated with you and you have complete freedom over what you choose to divulge. 

 

SENSITIVE INFORMATION

 

I understand that some information that may be requested in the nature of a consultation is of a particularly sensitive nature. I will be the only one who sees this information and will only collect it using secure methods such as the Simple Clinic client management software during a Zoom consultation.

You may also share sensitive information such as medical history, pathology results, home address, birth date and business details through other forms of communication such as direct email or private message, as well as via the intake form. Please see the security measures I take to ensure your safety in the Security section below. The reasons I collect this information are solely so I am able to provide you with the highest level of service for which you have engaged me.

Sensitive information may be collected from minors under the age of 18 with full consent from a parent or guardian, with this information stored in accordance with this Privacy Policy. Archived files will be deleted and securely destroyed after seven years. 

 

DISCLOSURE OF INFORMATION

 

I will take all reasonable safety measures to ensure the confidentiality and privacy of your personal information is maintained whilst in my possession. I will not knowingly disclose your information to any third party other than those who provide a service in assisting me in my service to you, such as pathology laboratories and other functional testing facilities. This will only be done with your consent and as long as the party involved maintains privacy standards that are in line with this one. I may use service providers that are overseas and therefore not bound by Australian Privacy Laws. If you have any concerns regarding your personal information in relation to such providers, I am happy to provide more information.

There may be certain circumstances where I am legally required to disclose your information to authorities, such as in response to a search warrant, subpoena or court order, or if I have reasonable grounds to suspect illegal activity or serious misconduct, with these circumstances permitted by the Privacy Act.

PROFESSIONAL CONSIDERATION

 

As a health professional, I abide by a number of regulations as set out by the association ANTA, of which I hold current membership.

 

Such regulations include:

  • Maintaining the privacy of your personal information unless you give explicit consent, I am required by law to disclose or there is serious risk to yourself or another person

  • Provision of records to you and other practitioners at your request

 

You may choose not to disclose personal information with me, however please note if you do not provide accurate personal information, I may not be able to provide you with the highest level of service. 

 

SECURITY

 

I will take all reasonable measures to ensure the privacy of your personal information is maintained at all times. This includes physical, technological and administrative safeguards to protect your information from unauthorized access, misuse and disclosure, as well as loss of information.

The ways in which I manage potential risks to your information include:

  • Password protected computer(s) with additional security measures from Norton LifeLock

  • Utilization of a unique zoom link that is generated with every booking

  • You will wait in a virtual waiting room until initiation of the consult and meetings will be locked immediately once commenced to ensure no intruders 

  • Client files are stored on Simple Clinic, a secure cloud-based server 

  • Login details are known only by me

  • Your personal details will only be released on a need to know basis to third party service providers, where it will then be managed in accordance with their Privacy Policies, and will only be released with your prior consent

 

I use G Suite as my email provider as well as social media platforms such as Facebook and Instagram and whilst reasonable measures are taken to ensure your privacy, I am not responsible for the maintenance of your privacy during transmission if you choose to use these as forms of communication with me. You agree that by participating in such forms of communication that there is an inherent risk of loss or disclosure of your information for which I am not responsible.

ACCESS TO INFORMATION

 

You may get in touch with me to access or update your personal information at any point in time. Access to your client file is rightfully yours and I will endeavour to make this information available within 14 days from the time of request. There may be certain circumstances in which I am bound to a confidentiality obligation or other restriction as outlined in the Privacy Act in which I may refuse you access to this information. If you request a correction or update to your personal information, I will amend this and inform you of such. There may be a cost incurred for the retrieval of your information, however this will be discussed on an individual basis.

Opt out of Marketing Communications

 

If you have chosen to subscribe to the mailing list, you may receive newsletters with blog posts or links to current research and relevant articles, recipes and other insightful information about nutrition and general health and wellbeing. If you would like opt out of this process, you may do so by clicking “unsubscribe”, or contacting me directly by email.

 

Notification of Changes

 

If I change or update my Privacy Policy in any way, the revised policy will be posted on my website and will be effective immediately. Please exit the site immediately if you do not agree to this policy. 

 

COMPLAINTS

 

If a breach of this Privacy Policy occurs, you may contact me directly via email at min@optimalyounutrition.com.au and I will endeavor to respond and address your concerns within 48 hours. If you are unsatisfied with my response and would like to take this issue further, you may contact the Office of the Australian Information Commissioner to lodge a formal complaint.
